Terms and Conditions of Use

1. Introduction

Welcome to CogniveaGPT.com, a platform designed to provide advanced AI-powered tools for document analysis, semantic extraction, and multi-modal understanding. By using our services—including but not limited to our API endpoints, user dashboard, models, and integrations—you agree to these legally binding Terms and Conditions.

If you do not agree with any part of these Terms, please do not use the Service.


2. Definitions

  • “CogniveaGPT”, “we”, “our”, or “us”: Refers to the CogniveaGPT platform, team, and any affiliated infrastructure.
  • “User”, “you”: Any individual, developer, company, or organization using CogniveaGPT’s services.
  • “Service”: Any feature, endpoint, dashboard, documentation, or API functionality provided by CogniveaGPT.
  • “Content”: Any file, data, message, input, or output submitted by or generated for a user.

3. Account & API Key Use

Each user or organization is responsible for the confidentiality and use of their API keys. Misuse, unauthorized access, or sharing of these credentials will result in immediate revocation of access and possible legal action.

You are solely responsible for all activity that occurs under your credentials or API usage. This includes usage by your software, employees, agents, contractors, or any third-party systems integrated into your workflow.


4. Service Scope & Availability

We provide access to state-of-the-art language and vision AI tools via:

  • Secure RESTful APIs
  • Token-authenticated user dashboard
  • Realtime streaming and structured output endpoints
  • SDK support (optional) in various languages

While we aim for 99.9% uptime, we do not guarantee uninterrupted availability. Scheduled maintenance, model upgrades, or infrastructure issues may result in brief service disruptions.


5. Non-Retention Policy for User Data

CogniveaGPT follows a strict non-retention policy for all user data:

  • No permanent storage of documents, images, texts, or API inputs.
  • No usage for training or fine-tuning our AI models.
  • No logging of content submitted to API calls unless explicitly enabled for enterprise auditing.

We process all user data ephemerally in memory, and discard it after inference. Only metadata such as token counts and success/failure status is stored for usage metrics and billing.

Your documents and inputs remain your property and are not indexed, cached, or used for any secondary purpose.


6. Intellectual Property

All software, APIs, documentation, and outputs generated by CogniveaGPT models are protected by copyright, trademark, and proprietary rights. Users may not copy, modify, decompile, or reverse-engineer the software or its outputs beyond the rights expressly granted.

Users retain ownership of their uploaded content, but grant CogniveaGPT a limited, temporary license to process it for the sole purpose of delivering results.


7. Acceptable Use & Restrictions

Users shall not:

  • Use the API for unlawful, deceptive, or harmful purposes.
  • Circumvent, probe, or exploit vulnerabilities in CogniveaGPT’s systems.
  • Upload offensive, violent, or illegal content.
  • Use CogniveaGPT to generate content that promotes hate, misinformation, or financial fraud.
  • Employ automated scripts or scraping tools beyond defined rate limits.

Violations will result in immediate suspension and may involve legal recourse.


8. Disclaimer of Liability for External Software

CogniveaGPT is not responsible for how users implement, secure, or deploy our API within their own software environments.

We offer AI processing as a stateless service. Once data leaves your system and enters our infrastructure for processing, it is transient and encrypted during transport (TLS 1.3).

However:

  • If you build an insecure application that leaks data through logs, frontends, or unprotected endpoints, CogniveaGPT bears no responsibility.
  • If your employees, contractors, or clients misuse the outputs or expose sensitive information, this is outside our control.
  • If a breach occurs on your infrastructure that involves content previously sent to our API, it is solely your obligation to investigate, report, and mitigate.

We do not act as a data controller under GDPR or similar regulations; we are strictly a data processor in transient capacity.

By using the service, you acknowledge that responsibility for API security, request handling, and data governance lies with you or your development team.


9. Logging, Telemetry & Observability

Unless you explicitly enable analytics or telemetry:

  • We do not track inference content or outputs.
  • Logs generated at runtime are ephemeral and used for internal debugging only.
  • Optionally, enterprise clients may enable OpenTelemetry-compatible streams, with signed data retention agreements.

You must not rely on us to store, retrieve, or archive any inference results.


10. Pricing & Billing

  • Free tiers, pay-as-you-go, or subscription pricing may apply.
  • Token usage, rate limits, and throttling policies will be enforced.
  • Failure to pay invoices or exceeding rate limits may result in temporary suspension.

No refunds will be issued for services rendered.


11. Limitation of Liability

To the maximum extent permitted by law, CogniveaGPT disclaims all liability for:

  • Loss of business revenue or data
  • Security breaches in third-party tools
  • Outputs that may be incorrect, biased, or legally inadequate
  • Errors caused by prompt design or model misinterpretation
  • Legal, medical, or financial actions taken based on AI results

We provide raw output only. Users must validate and use it at their own risk.


12. Termination and Suspension

We reserve the right to:

  • Revoke access for violation of terms
  • Suspend accounts for suspicious behavior
  • Modify or discontinue any part of the service at our discretion

Users may cancel their account at any time by contacting cogniveagpt@gmail.com. Deletion is irreversible.


13. Governing Law and Jurisdiction

These Terms are governed by the laws of the jurisdiction where CogniveaGPT operates. Disputes shall be settled in courts of competent authority in said jurisdiction.
